Terms and Conditions For Acceptance For Training And Testing & Disclaimer

(i) Acceptance for training and testing is subject to the Terms and Conditions herein and in any publicity material or correspondence as issued by Invicta Motorcycle Training.

(ii) Payment must be made for the prescribed course and / or test fee in part (as a deposit) and in full at the time and place directed.

(iii) All students must produce a valid signed Driving Licence and a Licence Check Code for Invicta to check the licence validity online. You can get a check code HERE. In the case of a rider being disqualified from driving when attending for training any monies paid will not be refundable and training will not legally be able to proceed.

Test training students must produce a valid theory test certificate before attending for an intensive course or attending for test. Where applicable, a valid CBT certificate and a Module 1 pass certificate must also be produced.

Where a student cannot provide appropriate documentation as required by the DVSA or Law, training and/or testing will not go ahead.

(iv) All students should attend wearing appropriate clothing for motorcycling. Shorts, ripped trousers exposing skin, soft shoes, sandals and non motorcycle gloves are not appropriate. We reserve the right to cancel training where the clothing is not suitable.

(v) Where a student uses their own motorcycle, it must comply with all legal requirements in existence at the time of training or testing and that there be produced a valid certificate of insurance and MOT if required.

(vi) All students should have a good knowledge of the Highway Code before attending CBT and test training. We reserve the right not to train students on the road where an insufficient level of knowledge could compromise road safety.

(vii) Before each training/testing session, full disclosure must be made by the pupil of any:

drug or medication (by prescription or otherwise) being taken that could impair their ability.

likelihood of alcohol intoxication

tiredness or fatigue that could affect vehicular operation

injury or illness that may affect riding or the safety of other staff and students

We reserve the right to postpone or cancel training if there are any safety concerns about a students fitness to ride.

(viii) Training and Testing (as arranged with and conducted by the Driver & Vehicle Standards Agency [DVSA] ) to be at the time, date and place specified and agreed. We are not liable for any errors, omissions or decisions made by this Agency.

(ix) In the event of cancellation the deposit paid for the CBT is non refundable. In case of all other courses the deposit will be £180. This is non-refundable but if 7 or more days notice is given course dates can be moved. Non attendance at the agreed time, date and place will be deemed a cancellation.

(x) Invicta Motorcycle Training reserves the right to cancel, amend or re-arrange the date, time and place of appointments (giving reasonable notice where possible) and without reasonable delay.

(xi) Invicta Motorcycle Training reserves the right to determine the riding standards in all aspects as criteria for submitting candidates for testing. Such criteria to be in accordance with regulations and guidelines issued by the DVSA.

(xii) All arrangements with the DVSA are subject to the terms and conditions of that Agency over which Invicta Motorcycle Training have no control.

(xiii) Invicta Motorcycle Training reserves the right to vary these Terms and Conditions without prior notice, but a copy of the current Terms and Conditions will be provided if requested prior to a booking arrangement being made.

Disclaimer

The safety of our clients is of paramount importance to us. However, motorcycle training and riding carries some risk to the student.

There are risks such as, but not limited to, trapping body parts in moving parts of the motorcycle, dropping the motorcycle onto yourself, falling from the motorcycle, or collision with stationary objects, moving or stationary vehicles. These incidents can result in injuries including, but not limited to; abrasions, cuts, wounds, bruises, sprains and fractures.

You must realistically accept that due to the nature of motorcycle riding and training, there is a possibility that an incident may occur that may cause a personal injury, death, loss, damage to your property, or expense to you.

Unless shown to be negligent, Invicta Motorcycle Training and their Instructors will not accept any liability or be subject to any claim for any death, injury, damage to property or other losses that you may suffer as a result of incident or accident whilst training with us. This includes if you use your own motorcycle.

All students will be required to read and sign this disclaimer before any training can be commenced to verify that they acknowledge and understand such risks.

By signing this disclaimer the student agrees to undergo training at their own risk and that they accept and consent to being subject to such risks.

For any rider training, the student should be satisfied that any training provided, or their own riding experience and ability, is appropriate for them to proceed with further training including off road, at the DVSA Motorcycle Manoeuvring Area riding and on a public highway in the prevailing weather conditions at that time.

For CBT training, before riding on the road (Element E), the student should be satisfied that the training they have received so far is adequate and they should feel sufficiently competent to proceed with a minimum of 2 hours riding on the public highway in the prevailing weather conditions.

In all cases, the student should consider that the motorcycle/scooter to be used for training is suitable for them to use for the purposes of the training.

Students confirm that for any training they are fit to ride, not unwell and not under the influence of alcohol or any drug (including prescribed that may affect their fitness to ride).

Students agree to wear corrective eyewear while riding if their eyesight requires it and/or as required by law.

Students are responsible for the control of the motorcycle and they must accept responsibility for their own actions during training and for any possible injury caused.

Students must agree that any instruction, advice or direction given by an instructor will require their due diligence to be applied safely. If they have any doubt they will ask for clarification, before following the advice or direction.

Students must make their instructor aware if they become distracted or fatigued and must report to their instructor at any time should they feel that they are not able or competent to continue with any element of training. Students may elect to cease training at any time by notifying their instructor.

Invicta Motorcycle Training  promotes safe riding with proper equipment. Motorcycle clothing cannot fully prevent all injuries, but it can reduce severity and protect from grazes and abrasions. Wearing non motorcycle clothing can result in more serious injuries in the event of an incident. We accept no responsibility for students who receive injuries as a result of wearing inadequate protection. We do not accept the wearing of trainers, sandals, tracksuit bottoms and shorts or any clothing that exposes the skin as you would be at risk of a serious injury. If clothing worn is viewed as inappropriate and unsafe then the student will be asked to rebook the training course at an additional cost.

In the unfortunate circumstances where a student sustains an injury, training will be ceased and appropriate first aid medical attention will be sought depending on the level of injury. Once assessed, and only if the student is content to continue, will training resume. This decision will be at the discretion of the client and the instructor.

All accidents and injuries will be reported to the DVSA in accordance with their guidelines.
